Organized jointly by SVIL and SVIFS, the competition simulates appellate-court proceedings where participants analyze a complex legal problem, draft written submissions, and argue cases before an esteemed panel of judges.
This year’s theme delves into one of the most debated aspects of matrimonial and constitutional law—the continuation of maintenance for divorced women amid live-in relationships.
The Moot Proposition
Set in the fictional Republic of Zindia, the case explores a divorce under the Hindu Marriage Act, 1955, raising profound questions of financial independence, live-in relationships, and constitutional morality. The protagonist, Anusha Reddy, challenges the termination of her maintenance after allegations of cohabiting with a male friend. Her ex-husband invokes gender equality and seeks relief from lifelong financial obligations.
The case confronts five pivotal issues, including:
- Whether discontinuation of maintenance can be justified on the basis of an alleged live-in relationship.
- Whether “financial independence” as a condition for terminating maintenance is legally valid.
